How We Plan to Indict David Miscavige and How This Time Is Different
The legal roadmap, the structure behind it, and why this isn’t just another fight; it’s the last one.
A Personal Note Before You Read On
Before we get into the strategy, I want to say something to the people who’ve been at this for years, some I abandoned for a decade, some I’ve stood beside, some I’ve watched from afar, and some I’ve only recently reconnected with.
This initiative doesn’t exist without everything you’ve already done.
The truth-telling, the lawsuits, the investigations, the documentaries, the writing it’s all part of this.
Some of you are already very much a part of this initiative, behind the scenes. And I hope more of you will join in, whether publicly or privately, as we take the next step.
Yes, we’re guarded about who’s in the inner circle and yes, there is one. Strategically, securely, and legally, that’s how it has to be.
We know how David Miscavige operates. We know what he’ll throw at us.
And we’re prepared to play by his rules dirty if we have to. But always legally, soundly, and professionally.
That’s why this isn’t a public roll call of who’s involved or who’s helping guide or support it.
We all agree: the names don’t matter right now. Only the direction.
And when we pull this off, it’ll be a win for all of us.
Because it was never about any one of us.
As for me and why now?
Because the time is finally right.
And because I owe it. One, to my old friend Mike Rinder who deserved better of me. And the other to Miscavige himself.
He knows why.
I’m not claiming to be the leader of anything. I’m just the ugly old mug putting my name on it and coordinating a few things. But I’m also putting myself on the line - if this fails you can blame it on me.
As of today, I’m committing to this, full-time, with everything I’ve got, until the job is done.
We appreciate your support. And yes, we need every bit of it we can get.
It won’t be cheap to pull off, but it won’t cost as much as you think, thanks to our structure and approach.
And the payback, even if not monetary, will be epic.
Below we are issuing, yes, in broad daylight for all to see, including OSA, DM, and his legal team, our approach.
Why openly? Because there’s nothing secret about exposing secrets and crimes.
We’ll give him a little of his own medicine.
Plus, everyone can follow along and put a shoulder to the wheel if they can.
And it should be fun….
One Last Thing
I want to take a moment to personally send regards to the key players who brought down Keith Raniere and NXIVM. You never gave up. You organized. You worked as a team. And you got the job done despite personal danger, constant attacks, and the weight of having to put your pride aside.
Moira Penza, Mark Lesko, Tanya Hajjar, Lauren Salzman, Sarah Edmondson, Catherine Oxenberg, India Oxenberg, Frank Parlato, Rick Alan Ross, the entire EDNY prosecution team
It’s not easy to admit to being in a cult, let alone to explain how and why. But what’s even harder is to keep going, to fight back, and to take the head off the snake.
You did that.
We’ve got Religious Recognition in David Miscavige’s corner or so he hopes which will make this more complex. But your work proved something critical:
Authoritarian control wrapped in pseudo-spiritual language is still criminal and still prosecutable.
Thank you for the inspiration.
We intend to follow through.
PS: Some resources are finally being put toward a secure website for IDMI, we’ll continue with substack until then and for now.
The Indict David Miscavige Initiative (IDMI):
What We’re Doing and Why It’s Different
This initiative isn’t just a new campaign.
It’s a legal and strategic correction, a deliberate restructuring of everything that has failed in the past.
For decades, survivors and critics of Scientology have tried to expose the abuse, file lawsuits, or bring accountability to the system. But those efforts repeatedly fell short, not because the stories weren’t true, but because the legal structures were flawed, the targets were wrong, and the timing wasn’t right.
We’ve learned from all of that.
And we’re doing it differently.
Our Strategic Approach: What Makes IDMI Different
1. Reframing the Target
We are not targeting Scientology as a belief system or even as a corporate structure.
We believe anyone has the right to believe in whatever they want to.
Our complaints are not with Scientology, they are with what David Miscavige has done to and with it.
We are targeting David Miscavige, personally, as a criminal actor who re-engineered and operates an abusive system for his own power and profit.
Religious protections do not apply to criminal conduct by an individual.
2. From Isolated Lawsuits to Patterned Criminal Exposure
Where past lawsuits (like the Headleys’) focused on individual stories, we are building a patterned, multi-witness criminal framework that establishes a system of abuse across decades, locations, and victims, with Miscavige at the top of that system.
This changes the legal equation. This isn’t employment law or religious discipline.
This is racketeering, forced labor, conspiracy, obstruction of justice, and continuing criminal enterprise.
And at the helm is David Miscavige.
3. Anchored in Federal Criminal Law, Not Civil Claims Alone
Previous cases leaned on civil employment law, easier to dismiss under First Amendment defenses, particularly when aimed at a recognized religion.
We are structuring this around federal criminal statutes (e.g., 18 U.S.C. §§ 1589–1594, RICO, CCE), where religious privilege does not apply to coercion, fraud, trafficking, or obstruction.
We are also prepared to cite relevant case law and legal precedent that affirms religious protections do not shield criminal conduct, such as United States v. Ballard and other controlling decisions, to reinforce our filings.
4. Building the Case Before Filing Anything
Unlike past efforts that filed prematurely, often without enough support or corroboration, we are:
Collecting sworn witness testimony using a standardized legal framework
Assembling documentary evidence, timelines, and corroboration
Mapping out direct benefit, control, and command by Miscavige
Establishing clear criminal intent and leadership role
This allows us to walk into court or a government agency with a case already built, not a case that needs to be discovered.
All declarations are structured using legally recognized templates, vetted internally for consistency, and stored with chain-of-custody and affidavit integrity in mind.
And because the Initiative is doing the legal prep work in-house, with qualified oversight, we don’t need millions to hire attorneys up front.
We’re creating a case strong enough that attorneys will want to take it on.
We believe our deep understanding of how David Miscavige turned Scientology into a criminal enterprise, from the inside out, will benefit both the filings and the eventual legal outcome.
5. Discovery Is the Reward, Not the Risk
In most lawsuits, civil discovery is dangerous. It exposes the plaintiffs and allows the defense to bury them in privilege claims or procedural traps.
We are flipping that model.
Because we’re preparing the foundation first, discovery becomes our weapon:
To force documents out of RTC, CST, IAS, and ASI that expose Miscavige
To depose current Scientology officers under oath (many of whom legally no longer exist)
To expose corporate fraud, financial misconduct, and shell operations
To put David Miscavige in a legal room he cannot control
And because our structure is strong, a court will have no legal basis to deny discovery when it begins.
This is what David Miscavige fears the most.
Once civil filings compel evidence through discovery, we intend to formally submit criminal referrals to relevant federal and state authorities with prosecutable documentation attached.
Why This Can Work Now, Not Then
This isn’t 2009. A few key things have changed:
We now know more about Miscavige’s control structure, how he bypasses boards, issues verbal commands, manipulates corporate filings, and uses religious cover to evade legal liability.
The smoke screen has lifted. We can now show that he is the system.
The legal climate has changed.
The Department of Justice and other federal agencies are actively prosecuting coercive labor systems, even in religious or therapeutic environments once seen as untouchable.
Federal law now reflects a broader understanding of psychological manipulation and abuse of authority.
Public and institutional will has shifted.
The Danny Masterson conviction, Leah Remini’s lawsuit, and widespread media attention have made it politically and socially unacceptable to ignore Scientology’s misconduct.
The system that once protected Miscavige now has cracks.
Leah Remini and her Foundation have publicly and credibly exposed the Church of Scientology.
Their work has radically shifted public perception, weakened Scientology’s PR defenses, and emboldened lawmakers, judges, and survivors to take action where once there was fear or indifference.
Comparable criminals, like Keith Raniere of NXIVM, have been exposed, indicted, and convicted.
What was once dismissed as “cult drama” is now understood as criminal enterprise.
Prosecutors and judges now see how authoritarian systems operate and that leaders like David Miscavige are not just abusive; they are prosecutable.
What We’re Collecting from Witnesses and Survivors
We are collecting legally structured declarations, not emotional anecdotes, testimony that will hold up in court.
Each crime category (e.g., forced labor, obstruction, child endangerment) has its own framework.
We are asking:
What happened
What David Miscavige did or ordered
Who else was there
What proof exists
How the system worked, because of him
If enough people tell the truth, clearly and legally, the pattern becomes undeniable.
The court can’t say “that’s just your story,”
because it’s everyone’s story,
and it’s all the same story.
What We’re Doing Concurrently
While we build the legal case outlined above, we are also taking public and strategic action to apply pressure directly on David Miscavige in real time. This includes:
Publicly exposing David Miscavige for who he really is, a violent and abusive man, and the architect of a decades-long system of coercion, control, and criminal misconduct
Reporting him to government agencies and demanding that law enforcement, regulators, and lawmakers investigate his actions, including personal enrichment, physical assaults, and his exploitation of nonprofit protections to evade scrutiny
Reaching out to current Scientology parishioners, staff, executives, and Sea Org members who have been shielded from the truth about Miscavige’s hostile takeover of their church, sharing documented facts, raising awareness, and building support to remove him from power
These efforts are not intended to confront faith, but to isolate the man who has corrupted it for his own gain.
In Summary
This isn’t about whether Scientology is a religion or a cult.
It’s not about belief, theology, or even policy, it’s about control.
What we’re exposing is what David Miscavige did:
He dismantled Scientology’s internal structure and oversight.
He violated its own rules and policies when they no longer protected him.
He built a system of fear, labor, surveillance, and retaliation, designed not to protect a religion, but to protect himself.
And he used its tax-exempt status and First Amendment shield as a legal fortress not to promote religious freedom, but to commit crimes in plain sight.
The Church of Scientology may or may not have redeeming value to some. That’s not our concern.
What we are here to prove, legally and publicly, is that David Miscavige turned it into a vengeful, criminal enterprise that:
Punishes its own members
Destroys its critics
Breaks the law to maintain his power
And has done so for four decades, beginning with his systematic takeover in the early 1980s
And let’s not forget the multiple incidents of direct psychological, emotional, and physical abuse that David Miscavige personally inflicted, not on external enemies, but on his own board members and executives.
Many of those individuals have since left the organization and nearly all have been subjected to retaliation, pressured into silence, or paid off in efforts to prevent disclosure. Some are MIA and being hidden away by Miscavige who hopes they’ll be forgotten or die before they are found and speak out.
This wasn’t abstract policy. It wasn’t organizational theory.
It was intentional misconduct, coercive control, and acts of physical violence
carried out by the man who still exercises absolute authority over the entire system.
These incidents alone warrant serious legal scrutiny.
He is not a religious leader. He is a man who has hidden behind religion long enough.
And now, it’s not about the Church. It’s about him.
We anticipate that multiple civil actions, if properly filed and strategically supported, will unlock the civil discovery necessary to expose further evidence, evidence that may support criminal prosecution and bring personal accountability to David Miscavige under the law.
The Goal
This is not about attention. It is not about venting.
And it is certainly not about deconstructing faith.
This is about:
Indicting David Miscavige for crimes he personally committed and crimes he ordered others to commit
Piercing the wall of privilege he has used for decades to shield himself from consequences
Forcing accountability through the legal system, not just the media
Giving survivors a real chance to be heard, not as isolated voices easily dismissed, but as part of a coordinated legal effort that no court can ignore
If you support this initiative, you're not supporting a rehash of the past.
You're supporting a strategic, prosecutable plan to bring down the man who has used religion to evade justice longer than almost anyone in modern American history.
We’re not asking for belief.
We’re building a case.
And when it’s ready, we’re going in like a controlled demolition.
Precision hits. No escape routes. Total exposure.
We won’t be quiet along the way.
We know how David Miscavige thinks.
We know how he plays the game.
And we’re prepared to play by those same rules.
That includes, when the time comes, walking into the IRS—face to face—and forcing the meeting that finally settles this.
Once and for all.
🔻 Help Us Indict David Miscavige
This isn’t about belief.
This isn’t about religion.
This is about one man—David Miscavige—who dismantled every system of accountability around him, eliminated all oversight, and built a criminal empire behind a religious front.
He thinks he’s untouchable.
The Indict David Miscavige Initiative is here to prove otherwise.
We're collecting sworn testimony. We're exposing the shell corporations. We're tracing the money. And we're building the legal case that strikes at the center of his control.
He doesn’t want the attention. So we’re giving it to him.
Donations are securely processed through Givebutter and go directly toward legal strategy, witness support, and public exposure. We are not yet a registered nonprofit, but every dollar is tracked, transparent, and used to target David Miscavige directly.
You've named a couple of people in your NXIVM roll-call that I consider friends. I will let them know about your effort. Godspeed.
This is amazing, Tom, and I've looked forward to this type of legal full-court press against the cult of SCN & David Miscavige for a long while now... I've already dropped mention of it in some courtroom 'chats' on YouTube, lol. I will promote it to everyone I think would have interest. This is exciting news. I always thought the Wollersheim case was super-intriguing as well.
